Terms of Service

    These terms govern the use of kundi.si and set out the general framework for working with us on IT services. By using the website you agree to these terms.

    Last updated: August 12, 2026

    1. General

    The kundi.si website is operated by KUNDI, Ozare 19, Slovenj Gradec, Slovenija (“we”, “us” or “the provider”).

    If you do not agree with these terms, please do not use the website.

    2. Website content

    The content on this website is provided for information purposes. We work to keep it accurate and up to date, but we make no warranty that it is complete or fit for any particular purpose.

    Published information does not constitute a binding offer, nor legal or security advice. For your specific situation, please contact us directly.

    3. Quotes and contract formation

    Prices shown on the website are indicative starting points. Only a written quote prepared in response to your enquiry is binding.

    A contractual relationship is formed once a quote is confirmed in writing or a contract is signed. Where these terms conflict with an individual contract, the individual contract prevails.

    4. Scope of services

    Our services cover DevOps, system solutions, infrastructure management, database and cloud cost optimisation, custom development, and cybersecurity services including penetration testing.

    The precise scope, deadlines, response times and any service levels (SLA) are defined in the applicable quote or contract.

    5. Security testing and authorisation

    Penetration testing and other offensive security services are performed only under prior written authorisation from the client, who must have the right to approve testing of the target systems.

    The client warrants that it holds all necessary consents, including those of hosting or cloud providers. Testing is carried out within the agreed scope and time window; findings are confidential and intended solely for the client.

    6. Client obligations

    • provide accurate information, access and points of contact needed to deliver the services, in good time;
    • hold valid licences and rights to the systems the services are performed on;
    • maintain backups before any work is carried out on production environments;
    • handle credentials responsibly and report any suspected misuse without delay.

    7. Acceptable use of the website

    When using the website you must not:

    • attempt to gain unauthorised access to the website, our servers or connected systems;
    • run security scans or tests without our explicit written permission;
    • interfere with the operation of the website, for example through automated bulk access or overload;
    • harvest data from the website by automated means without permission;
    • publish or transmit unlawful, misleading or harmful content.

    8. Intellectual property

    All website content, including text, graphics, logos and source code, is protected by copyright and belongs to the provider or its licensors.

    You may not copy, distribute or commercially exploit this content without our written consent. Rights to project deliverables are set out in the individual contract; until payment is made in full, those rights remain with the provider.

    9. Fees and payment

    Unless agreed otherwise, invoices are issued after the service is delivered or at agreed milestones, payable within 15 days of the invoice date.

    For late payment we may charge statutory default interest and suspend delivery of services until outstanding amounts are settled.

    10. Confidentiality

    We treat all information obtained while delivering services as confidential and use it only to perform the agreed work. The same obligation applies to the client with respect to our methodologies, reports and tooling.

    Confidentiality obligations survive the end of the contractual relationship.

    11. Warranties and limitation of liability

    We deliver our services professionally and diligently, in line with established industry practice. We do not warrant that any system will be entirely secure or error-free, as security also depends on factors outside our control.

    Our liability is limited to direct damages and capped at the amount the client paid for the service concerned in the preceding 12 months. We are not liable for lost profits, loss of data or indirect damages, except in cases of intent or gross negligence.

    12. Termination

    Either party may terminate the engagement in accordance with the individual contract. On termination the client settles all services delivered up to that point, and we return or delete credentials and confidential material as agreed.

    13. Force majeure

    Neither party is liable for failing to perform due to events beyond its reasonable control, such as network or cloud provider outages, natural disasters, strikes or acts of authorities.

    14. Governing law and jurisdiction

    These terms are governed by the law of the Republic of Slovenia. We aim to resolve disputes amicably; failing that, the competent court in Slovenia has jurisdiction.

    15. Changes to these terms

    We may update these terms from time to time. Changes take effect when published on this page and do not affect contracts already concluded.
